The following statement discloses the privacy practices for the Audio Precision web site (www.ap.com). This statement does not describe how we collect or maintain information we obtain from you offline, such as through phone or email contact.

1 – Your Agreement to this statement

Your use of this web site signifies that you have read, understand, and agree with all of the terms of this statement. If you do not agree to all of the terms of this statement, do not use this web site. If you are acting on behalf of an entity, you represent that you have full authority to bind your entity to this statement. If you do not have such authority, do not use this site. You agree that this statement is supported by reasonable and valuable consideration (including your use of this site), the receipt and sufficiency of which you acknowledge.

2 – The Collection of Personal Information and Automatically-Collected Information **
a. Personal Information. On certain pages, we give users the option of providing us with names, addresses, phone numbers, fax numbers, email addresses, demographic data (such as zip codes), user preferences, passwords, details regarding the company for whom you work, and various other kinds of personally-identifying details you actively enter into the site, including without limitation any personal information you provide in an open text box (collectively, “Personal Information”). For example, we may collect Personal Information from you when you choose to register for an account through the site or complete and send us a form to contact us in order to schedule a product demonstration, request service, or for another purpose. Also, when you use the site, in addition to the other third-party sites to which you may link from our site, you may click on a link that will take you to a third-party website in order to register for events we highlight and describe on our site. If you register for an event through such a third-party website, you will need to provide Personal Information (including some of the types of Personal Information listed above and including financial information, such as credit card and billing address, and other information that may be collected by such third party). We will be given some of this Personal Information, as necessary for the event for which you register, but we will not be given your financial information. When we are given your Personal Information regarding an event for which you register through such a third-party site, we will treat your Personal Information according to our privacy statement. Please carefully review any privacy statement associated with any such third-party website before you continue to use the third-party site and before you register for an event through such third party. Personal Information you provide through the third-party site will be in the third party’s possession, and when such information is in the third party’s possession, it will be subject to the third party’s privacy statement.

YOU DO NOT HAVE TO PROVIDE US WITH YOUR PERSONAL INFORMATION TO BROWSE THE SITE, AND WE ONLY COLLECT PERSONAL INFORMATION WHEN YOU VOLUNTARILY PROVIDE IT. YOU ARE NEVER UNDER ANY OBLIGATION TO PROVIDE US YOUR PERSONAL INFORMATION. However, if you do not provide Personal Information, you will not be able to use certain features of the site. When you do provide us your Personal Information, you are authorizing us to use that information in accordance with this statement and to store your information on our servers located in the United States.

b. Automatically-Collected Information. Audio Precision collects aggregate information site-wide, including anonymous site statistics, as you browse and navigate the site. This information may include the date and time of your visit, the duration of your visit, the type of browser and browser language you use, domain names and/or IP addresses, your mobile device ID, the type of computer or other operating device used, the actions you take on the site (such as pages viewed and links clicked), and the website from which you linked to our site (collectively, “Automatically-Collected Information”). We use this Automatically-Collected Information in the aggregate to inform us regarding what services, products, and site features users look at most frequently. We also use Automatically-Collected Information as described elsewhere in this statement. Unless otherwise stated in this statement or prohibited by law, we may combine Automatically-Collected Information with your Personal Information. We gather Automatically-Collected Information from you passively. We use common information-gathering tools, such as those described here, to collect Automatically-Collected Information as you navigate the site. This Section 2(b) describes in further detail the types of Automatically-Collected Information we may collect and how we may use it.

(i) Cookies. We use an Internet browser feature called “cookies” to make your interactions with the site easy and meaningful. When you visit the site, our servers send a cookie to your computer or other operating device. The cookie is placed on your hard drive, and it assigns your computer or operating device a unique, random number that acts as a sort of anonymous ID. Standing alone, a cookie does not personally identify you; rather, a cookie identifies the computer or operating device used to access the site. Unless you choose to identify yourself to us, such as by filling out a web form or creating an account, you remain anonymous to us when browsing the site; in other words, the cookie alone will not allow us to identify you personally.

There are two types of cookies: Session-based and persistent-based. Session cookies exist only during one session, and they disappear from your computer or operating device when you close your browser software or otherwise end your session. Persistent cookies remain on your computer or operating device after you close your browser or otherwise end your session. If you have created an account on the site, we use session cookies containing encrypted information to allow us to uniquely identify you each time you log into your account and to process your requests. Session cookies are required to use your account. We also use session cookies to provide us information about site features used and activities conducted while using the site, regardless of whether you have an account.

We also use persistent cookies for our registered users’ convenience to allow them to remain logged into their accounts, even if they close their browsing session. Please be aware that if you do not log out of your account before you close your browser, you will remain logged into your account. If you choose not to log out of your account, we highly recommend you only do so on a private (and not public) computer and that you maintain the security of your private computer.

In addition to the above, cookies may be used to remember your personal settings, pre-fill forms for you, and monitor your use of the site to improve our services.

Most browsers automatically accept cookies, but you can disable the acceptance of cookies at any time by changing the preferences in your browser. (ii) Web beacons. We use web beacons alone or in conjunction with cookies to compile Automatically-Collected Information about your use of the site, as well as your interaction with emails from us. Web beacons are clear electronic images imbedded in a web page, site feature, or email, which can recognize certain types of information on your computer or other operating device, such as cookies, when you viewed a particular site tied to the web beacon, and a description of a site tied to the web beacon. For example, we may place web beacons in marketing emails that notify us when you click on a link in the email that directs you to the site. We use web beacons to operate and improve the site and email communications and to statistically monitor how many people are using the site and opening our emails and for what purposes. We do not collect Personal Information with web beacons.

(iii) IP addresses and mobile device IDs. When you visit the site, we collect your IP address and/or mobile device ID to track and aggregate Automatically-Collected Information. We also collect IP addresses from users when they log into their accounts on the site in order to confirm the applicable user’s identity.

3 – Use of Collected Information
(a) Audio Precision uses the Automatically-Collected Information and Personal Information we collect through our site to tailor our users’ web experience (which could include displaying site content based upon user preferences or activities conducted on the site) and to generate anonymous statistics, general trends in our site traffic, and demographic data to compile information that will help us improve our site, products, and services. For example, we might use Automatically-Collected Information to track what site users look at most frequently so we can recognize and deliver more of the desired content, products, and services. We may also use Automatically-Collected Information and Personal Information to help diagnose problems with the site, to ensure the site will appear and function appropriately on your computer, and to determine which website referred you to our site. We and our sales partners (described in Section 4(b) below) will see what information you download from our site and may then contact you regarding your interest in a particular product or service associated with such download.

(b) We use Personal information, such as names and addresses, to contact those who have requested information, to set up user accounts, to otherwise perform actions you request, and to provide required notices or information about specific transactions. We also use Personal Information for marketing purposes, as described more fully in Section 6. See information in Section 4 about how we may share your Personal Information with our sales partners so they can contact you regarding your potential interest in our products and to respond to your requests.

(c) We may combine Automatically-Collected Information and Personal Information we get from you through your use of the site with information about you that we obtain from third parties.

(d) We may use Automatically-Collected Information and Personal Information as otherwise described in this statement and as otherwise permitted by law.

(e) We require this information to understand your needs and to provide you with better service and, in particular, for the following reasons:

  • Improving our products and services

Since AP is part of Axiometrix Solutions www.axiometrixsolutions.com and often offer combined services and solutions, we may share your contact information and purchasing history with our sister companies GRAS Sound and Vibration or imc Test and Measurement.

4 – Sharing Collected Information
Audio Precision does not share Personal Information with third parties, except as expressly described here:
(a) Event Registration. Remember if you register for an event that we advertise on our site, you will be sharing your information with a third party through the third party’s event registration website, and your information is subject to the third party’s privacy statement.

(b) Sales Partners. When you register for an account on our site, if your location is outside of the United States, we will share your Personal Information and some Automatically-Collected Information with our sales partners/product distributors located in or otherwise responsible for your region. In such event, our sales partner responsible for distributing product within your geographic region will be given all of your Personal Information that you input into the site and will be given information regarding any documents you download from our site. Our sales partner will then contact you directly regarding your interest in our products and services. See Section 6 for instructions regarding how to contact us to request that we stop sharing your Personal Information and Automatically-Collected Information with our sales partners for marketing purposes.

(c) Third-Party Service Providers. We may share your Personal Information with our third-party service providers to provide information or services on our behalf that our users have requested from us, to perform certain marketing on our behalf, and/or to perform site analytics or other services relating to operation of our site (such as hosting, data storage, and security). Any third-party service provider will be required to not disclose the Personal Information to others, to not share that Personal Information with marketers for their own direct marketing purposes, and to not use the Personal Information in any way other than as described in this statement. Further, any third-party service provider will be required not to send communications to Audio Precision customers, except in connection with an Audio Precision service or product or other requested transaction. Audio Precision will not sell, rent, loan or give your Personal Information to marketers for their own marketing purposes.

(d) Merger, acquisition, or sale. We may share or transfer Personal Information and Automatically-Collected Information to a third-party successor to all or any part of our business. In this event, we will, if allowed, use reasonable efforts to notify you when your information is shared with or transferred to any third party by posting such notice on the site and/or by contacting you via the Personal Information you have provided us, if any.

(e) Required by law. Nothing in this statement is designed to protect the privacy of users who use our site for illegal, fraudulent, abusive, or otherwise improper purposes. We reserve the right to disclose your Personal Information and Automatically-Collected Information when we reasonably believe it is necessary (a) to investigate, prevent, or take action regarding improper activities or suspected fraud, to establish or exercise our legal rights, or to defend against legal claims; (b) to protect our other site users or our employees, property, or business; or (c) to comply with any law, rule, regulation, judicial proceeding, subpoena, or similar legal process.

(f) De-identified information. We may share de-identified, aggregated Automatically-Collected Information without restriction.

5 – Security
Audio Precision uses industry-standard measures to protect against the loss, misuse, and unauthorized access, disclosure, and alteration of Personal Information and Automatically-Collected Information that is under our control.

We encourage you to use caution when using the Internet. Please notify us if you become aware that your Personal Information is lost, stolen, or used without permission. If you have an account on our site, please maintain the security of your username and password and do not share your username and password with any third party. You are responsible for all activity that occurs under your username and password, whether with or without your knowledge.

Unfortunately, no data storage system or system of transmitting data over the Internet or wireless network can be guaranteed to be 100% secure, and no security system can prevent all security breaches. As a result, we do not and cannot guarantee the security of our servers or any Personal Information or Automatically-Collected Information provided to us. Any transmission of your information to us is at your own risk.

6 – Processing in the European Economic Area (EEA)
For users with accounts located in the European Union, all processing of Personal Data is performed in accordance with privacy rights and regulations following the EU Directive 95/46/EC of the European Parliament and of the Council of 24 October 1995 (the Directive), and the implementations of the Directive in local legislation. From May 25th, 2018, the Directive and local legislation based on the Directive will be replaced by the Regulations (EU) 2016/679 of the European Parliament and of the Council of 27 April 2016 on the protection of natural persons with regard to the processing of Personal Data and on the free movement of such data, known as the General Data Protection Regulation (GDPR), and Audio Precision’s processing will take place in accordance with the GDPR.

7 – Controller
Audio Precision processes Personal Data as a Controller, as defined in the Directive and the GDPR:

Audio Precision, an entity, which you as a user entered an agreement with when using Audio Precision’s platform, will be the Controller for User data, as outlined above in “Collection of Personal Data” section. Audio Precision adheres to the Directive of 1995 and the GDPR from May 25th, 2018. All data collected by Audio Precision users will be stored in secure hosting facilities. All transfers of data internally in the EEA is done in accordance with this data processing agreement.

8 – Processing in other regions
For users with accounts in other regions, Audio Precision has adopted reasonable physical, technical and organizational safeguards which mirror the EU safeguards against accidental, unauthorized or unlawful destruction, loss, alteration, disclosure, access, use or processing of the users’ data in Audio Precision’s possession. Audio Precision will promptly notify the User in the event of any known unauthorized access to, or use of, the user’s data.

All user data collected by Audio Precision will be stored in secure hosting facilities. Accordingly, Audio Precision adheres to practices and policies that aim to safeguard the data.

9 – Your Choices; Opt-out Rights; Correcting and Updating Your Personal Information
We may include you on our marketing communications list when you actively provide us your email address for any reason and/or if you consented to being placed on our marketing communications list. Audio Precision allows users to opt out of receiving marketing communications from Audio Precision by contacting us at [email protected] or by following the unsubscribe instructions in any promotional message you receive from us. You may also contact us at [email protected] to request that we not share your information with our sales partners. If you opt out of receiving marketing communications from us, we reserve the right to contact you regarding your use of the site, product purchases, your account, or other transactions.

If you have set up an account, you can modify and update your Personal Information associated with your account by logging into your account and updating your information. Regardless of whether you have an account, you can modify and update, or ask us to delete from our databases, Personal Information you have given us by contacting us at the contact information listed below. If you request that we delete or change your Personal Information, we will use commercially-reasonable efforts to remove your existing Personal Information, but see Section 10 below for reasons why we may retain some information.

You can control your browser’s acceptance of cookies as described in Section 2(b) above.

10 – Changes to this Privacy Statement
Audio Precision reserves the right to change this privacy statement at any time in its sole discretion. If we make changes to this privacy statement, we will conspicuously post that fact on our site and post the revised privacy statement on our site. Unless a later date is indicated, any changes will be effective when we post the changes on our site, and you can determine if this statement has been revised since your last visit to the site by referring to the “last updated” date at the top of this statement. We encourage you to review this privacy statement frequently. We will also send you direct notice of any material changes to this statement if we have your current contact information AND if required by law. Your use of our site following changes to this statement constitutes your acceptance of and agreement to the terms of this statement, as revised by us.

11 – Intended Users of our Site; Children’s Privacy
Our site is intended for adults only. The site may not be appropriate for use in some jurisdictions outside of the United States, and use of the site is unauthorized in any jurisdiction that does not give effect to all of the provisions of this statement.

13 – Retention
We will not retain Personal Information and Automatically-Collected Information in our databases longer than is necessary to fulfill the purposes for which it was collected or as required by applicable laws. You can contact us via the contact information below and ask us to remove your information from our databases. Note that even after you ask us to remove your information from our databases, it may be impossible to remove some information, such as information tracked in our web server log files and information that may reside in backup files. We may also retain Automatically-Collected Information even after you request that we remove your information from our databases, if it is aggregate information with no markers of identification to analyze and improve the site. Further, even after you request that we remove your information from our databases, we may retain Personal Information and Automatically-Collected Information to comply with any applicable law, rule, regulation, or guideline; to prevent fraudulent activity; to protect ourselves against liability; and to allow us to enforce our contractual or other rights and to pursue available remedies and limit any damages we may sustain.

15 – Enforceability
If any part of this statement is determined to be invalid or unenforceable pursuant to applicable law, then the invalid or unenforceable provision will be deemed superseded by a valid, enforceable provision that most closely matches the intent of the original provision, and the remainder of the statement shall continue in full force and effect.
